Arbitration Association reports that over 85% of all
mediations result in a settlement.
Mediation
provides an informal environment that is more conducive for
settlement negotiations. It promotes communication and
cooperation. Unproductive discussion can be avoided to
promote mutual exploration of options, addressing each
party’s underlying interests, looking at alternative ways of
solving the issues at hand, and moving the dispute towards a
quicker, more cost effective resolution.
Mediation saves
time and money avoiding the high cost of long delays
associated with trials, attorney’s fees, expert witness
fees, court fees, and other related expenses.

litigation places the outcome of the case in the hands of a
judge or jury to decide. Mediation allows the parties to
retain the control of their dispute, resolve the problem

Mediation is
confidential, avoiding public disclosure of personal
information. All discussions and all information developed
for mediation are not admissible in any subsequent
proceeding, except for a finalized and signed mediated
agreement. No record is made of the mediation.
